Terms & Condition

This Catering Agreement is entered into between Earth Local Coffee LLC (Caterer”)and the company/person paying for coffee catering services (“Client”) and sets forth the agreement between the parties. By paying the required deposit, the client agrees to the terms and conditions outlined below:

1) Event details

Client is hiring caterer to provide coffee beverages and related services. Event details will be outlined in the inquiry form and confirmed in writing by the company. Any changes to these event details must be made direct to Earth Local Coffee with at least 7 days notice before the event start date and may require additional payment. Earth Local Coffee reserves the right to adjust small changes to the menu if key ingredients become unavailable due to circumstances beyond its control.

2) Coordination with venue

Caterer will need the venue no later than 1.5 hours prior to the event time and 1 hour after the event for clean up and load out.Client is responsible for securing permissions or covering venue costs and fees. Outdoor service is possible with no chance of rain and temperature between 40 degrees F -90 degrees F. Client is responsible for providing nearby parking or covering parking fees.

3) Booking and payment terms

The Event date is only reserved once the agreement is signed and the deposit is received. Deposit: a non refundable deposit of 50 percent of the total service cost is due upon acceptance of this agreement. Final Payment: the remaining balance is due 5 days prior to the event. A late fee of twenty five dollars per day will apply to unpaid balances.Travel fees may apply outside of Los Angeles area.

4) Electricity and power requirements

Electricity and power will be provided by the client. Must provide 1-2 dedicated 120v/15-AMP circuits. Caterer will provide all extension and power strips if needed. The client must notify the caterer at least 7 days in advance if an extension cord is needed. Without adequate power, espresso machines can malfunction and cause damage. If adequate power is not available the caterer will not be held liable for damages and no refund will be issued. The client is solely responsible for ensuring the venue meets these power requirements.

5) Branding and photography

We reserve the right to photograph or video the setup and drinks for marketing purposes unless otherwise requested in writing.

6) Insurance

Caterer has or will obtain General liability Insurance covering the services provided at the event.

7) Indemnification

The client agrees to indemnify caterer for any damage, theft, or loss of the caterer property occurring at the event caused by the client, guests, or staff. We are not responsible for injuries or damages occurring outside of our direct service area.

8) Cancellations and rescheduling

For events canceled 30+ days before event 50% of deposit will be refunded. For events canceled within 30 days of event, no refunds will be issued.For special order items the client is responsible for costs of order items purchased for the event even if the event is cancelled. Rescheduling is dependent on Caterer availability on the requested date and reschedule requests require at least 10 days notice.

9) Liability Limitations

The company shall not be liable for indirect, incidental, or consequential damages.

10) Governing law and venue

This agreement is governed by and interpreted under the law of the state of California. Any legal proceedings shall be initiated in California courts.

11) Entire Agreement

This agreement constitutes the entire understanding between the parties and supersede all prior discussions or agreements. Any changes or amendments must be made in writing and signed by both parties to be enforceable.

12) Acceptance

By submitting the deposit, the client acknowledges and agrees to all terms of this agreement. The company’s receipt of the deposit confirms the booking.
